Copyright and Licensing Policy
Justitia Nova: Indonesian Journal of Modern Law is committed to facilitating the broad dissemination of scholarly research while safeguarding the intellectual property, moral rights, and legitimate interests of authors. The journal adopts a transparent and internationally oriented copyright and licensing framework consistent with its Open Access publishing model. The policy is designed to promote responsible knowledge sharing, facilitate lawful reuse, and ensure that authors retain meaningful control over their scholarly work while enabling the journal to disseminate and preserve the published scholarly record.
Copyright
Authors who publish in Justitia Nova retain copyright ownership of their published works. Publication in the journal does not constitute a transfer of copyright ownership to the publisher. Instead, by submitting and publishing a manuscript, authors grant Justitia Nova a non-exclusive right to publish, reproduce, distribute, communicate, and archive the accepted and published version of the work in print and electronic formats and through appropriate scholarly dissemination channels.
The journal is authorized to identify itself as the original publisher of the work and to preserve and disseminate the published version through its official platform, indexing and abstracting services, digital repositories, library systems, and other recognized scholarly preservation and discovery infrastructures.
Authors retain the freedom to reuse and further disseminate their published work. They may incorporate all or part of the article into future books, theses, dissertations, lectures, teaching materials, conference presentations, or other scholarly publications, provided that the original publication in Justitia Nova is appropriately acknowledged.
Authors may also deposit and share the published version through institutional repositories, personal academic websites, scholarly communication platforms, and other lawful repositories, subject to the terms of the applicable license. No additional permission from the journal is required for reuse that is consistent with the Creative Commons Attribution 4.0 International (CC BY 4.0) License.
Licensing
All articles published by Justitia Nova are distributed under the Creative Commons Attribution 4.0 International (CC BY 4.0) License, unless otherwise explicitly stated for a particular publication. The adoption of this license reflects the journal’s commitment to Open Access and to the broad and responsible dissemination of legal scholarship.
The CC BY 4.0 License permits users to copy, reproduce, share, and redistribute the published material in any medium or format. It also permits users to adapt, remix, transform, and build upon the material for both non-commercial and commercial purposes.
Reuse under the license is permitted provided that users comply with its attribution requirements. Users must provide appropriate credit to the original author or authors, identify Justitia Nova as the original source of publication, provide a reference or link to the applicable CC BY 4.0 License, and indicate whether changes have been made to the original material.
The attribution should be sufficiently clear to enable subsequent users to identify the original authorship, publication source, and licensing conditions. Adaptations or derivative works should not be presented in a manner that falsely suggests endorsement by the original authors or Justitia Nova.
Author Rights
Authors retain copyright ownership and the moral rights associated with their published works. These rights include the right to be identified as the original creator of the work and to have appropriate attribution maintained when the work is reused or redistributed.
Authors retain the right to reuse, reproduce, distribute, archive, and communicate their published articles in accordance with the terms of the CC BY 4.0 License. They may also authorize or permit others to reuse their work under the same licensing framework without requiring separate authorization from the journal, provided that the applicable license conditions are respected.
The journal encourages authors to disseminate their research through appropriate academic and professional channels in order to enhance the visibility, accessibility, discoverability, and scholarly impact of their work.
Third-Party Materials
Authors are responsible for ensuring that all third-party materials incorporated into their manuscripts are used lawfully and with appropriate permission where such permission is required. Third-party materials may include figures, tables, photographs, maps, illustrations, datasets, substantial quotations, instruments, or other materials protected by copyright or other intellectual property rights.
Where third-party permission is required, authors must obtain the necessary authorization before publication and should retain appropriate documentation of that permission. Authors should also provide clear attribution and acknowledge any licensing conditions associated with third-party materials.
Third-party materials included in a published article do not automatically fall under the CC BY 4.0 License if they are subject to separate copyright or licensing restrictions. Any applicable restrictions should be clearly identified within the published article.
License Compliance
Any reuse of material published by Justitia Nova must comply with the terms and conditions of the Creative Commons Attribution 4.0 International (CC BY 4.0) License and any applicable restrictions relating to third-party materials.
Users who reuse published content are responsible for providing accurate attribution and preserving relevant information concerning authorship, publication, licensing, and modifications. Failure to provide appropriate attribution, misrepresentation of authorship, removal or alteration of relevant rights information, or use of third-party material without the necessary authorization may constitute a violation of applicable copyright or intellectual property law.
Where a particular use falls outside the permissions granted by the CC BY 4.0 License, the user may need to obtain additional permission from the relevant rights holder.
Copyright and Scholarly Integrity
The journal recognizes that copyright protection and Open Access are complementary rather than competing principles. Retaining copyright with authors while applying a permissive Open Access license allows scholarly work to remain widely accessible while preserving attribution and recognition of intellectual contribution.
Accordingly, Justitia Nova seeks to ensure that published research can be reused, shared, and built upon in ways that promote academic advancement while maintaining appropriate standards of attribution, scholarly integrity, and responsible knowledge dissemination.
Commitment to Open Scholarship
Through this copyright and licensing framework, Justitia Nova: Indonesian Journal of Modern Law supports an open, transparent, and internationally connected scholarly communication environment. The journal seeks to maximize the accessibility and reuse of legal research while protecting authors’ intellectual property and moral rights.
The policy reflects the journal’s broader commitment to responsible Open Access publishing, academic transparency, research integrity, and the unrestricted dissemination of knowledge. By enabling lawful sharing, adaptation, archiving, and reuse under the CC BY 4.0 framework, Justitia Nova aims to strengthen the visibility, accessibility, and long-term scholarly and societal impact of contemporary legal research.
