Research Integrity and Misconduct Policy
Justitia Nova: Indonesian Journal of Modern Law is committed to maintaining the highest standards of honesty, transparency, accountability, and responsibility throughout the research and publication process. The journal expects authors, reviewers, editors, and the publisher to uphold responsible research practices and to protect the integrity of scholarly communication throughout manuscript submission, peer review, publication, and post-publication activities.
This policy is guided by internationally recognized principles of research integrity, the Committee on Publication Ethics (COPE) Core Practices, and other established standards of responsible scholarly publishing. Justitia Nova maintains a zero-tolerance approach to research and publication misconduct and is committed to identifying, investigating, and responding to allegations of misconduct in a fair, transparent, confidential, and evidence-based manner.
Principles of Research Integrity
Research published in Justitia Nova is expected to uphold honesty in the conduct, analysis, reporting, and communication of research. Authors and other participants in the publication process are expected to ensure the accuracy of research data, legal materials, analyses, interpretations, and conclusions. Transparency should be maintained in relation to research methods, authorship, funding, conflicts of interest, ethical approval, and the use of Artificial Intelligence (AI), where applicable.
All individuals involved in the publication process share responsibility for maintaining the reliability and integrity of the scholarly record. The journal therefore promotes fairness, objectivity, accountability, confidentiality, and respect throughout the editorial and peer review processes.
Responsibilities of Authors
Authors are responsible for ensuring that their research is conducted and reported in accordance with applicable ethical, legal, and institutional requirements. Research findings must be presented accurately and honestly, without fabrication, falsification, manipulation, or deliberate misrepresentation.
Authors should maintain appropriate research records and ensure that relevant evidence, legal materials, data, and analytical procedures can be adequately explained when necessary. All sources must be properly acknowledged through accurate citation and referencing. Authors must also disclose relevant funding, conflicts of interest, ethical approvals, and significant use of AI tools where applicable.
Authors are expected to cooperate fully with the Editorial Office when questions concerning the integrity of their research arise. If a significant error or ethical concern is identified after submission or publication, authors should promptly notify the Editorial Office and cooperate with any necessary investigation or corrective action.
Responsibilities of Reviewers
Reviewers are expected to evaluate manuscripts objectively, fairly, confidentially, and solely on the basis of their scholarly merit. Reviewers should disclose any actual, potential, or perceived conflict of interest before accepting a review assignment and should decline the assignment when their impartiality may reasonably be compromised.
Reviewers should promptly notify the editor of suspected plagiarism, duplicate publication, citation manipulation, research misconduct, or other ethical concerns identified during the review process. Confidential manuscript content and unpublished information obtained through peer review must not be used for personal or professional advantage.
Responsibilities of Editors
Editors are responsible for maintaining a fair, transparent, independent, and impartial editorial process. Manuscripts should be evaluated according to academic quality, originality, methodological rigor, legal significance, and relevance to the journal's aims and scope.
Editors must maintain confidentiality throughout the editorial process and respond appropriately when allegations concerning research integrity arise. Where credible concerns are identified, editors are responsible for initiating an appropriate assessment or investigation and taking proportionate editorial action to protect the integrity of the scholarly record.
Research and Publication Misconduct
Research or publication misconduct includes any deliberate or serious violation of accepted standards of scholarly integrity. Such misconduct includes, but is not limited to, fabrication of data or research results, falsification or manipulation of research materials, methods, legal documents, images, tables, or findings, and plagiarism in any form.
The journal also considers duplicate or redundant publication, simultaneous submission to multiple journals, citation manipulation, citation stacking, coercive citation, improper authorship practices, undisclosed conflicts of interest, peer review manipulation, and misrepresentation of ethical approval, funding information, or author contributions to constitute serious breaches of publication integrity.
The deliberate use of fabricated, misleading, or unverifiable references is prohibited. Similarly, the deliberate misuse of Artificial Intelligence to generate false research findings, fabricated references, misleading evidence, or deceptive scholarly content may constitute research misconduct.
Investigation Procedure
Allegations of research or publication misconduct may be raised before or after publication by authors, reviewers, editors, readers, institutions, funding organizations, or other relevant stakeholders. All allegations will be assessed and, where appropriate, investigated in a fair, objective, confidential, and evidence-based manner.
The Editorial Office may conduct an initial assessment of the allegation, request relevant evidence or supporting documentation, seek clarification from the corresponding author or other authors, consult reviewers or independent experts, and contact the authors' affiliated institutions or funding organizations where appropriate.
Where necessary, editorial processing or publication may be temporarily suspended while an investigation is conducted. The journal may also refer to relevant COPE Flowcharts and other recognized publication ethics guidance when determining an appropriate course of action.
Due Process
The journal is committed to procedural fairness in all investigations. Authors and other relevant parties will be provided with a reasonable opportunity to respond to allegations and provide supporting information before a final editorial decision is reached, where appropriate.
Editorial actions will be based on the available evidence, the seriousness and nature of the concern, applicable ethical standards, and the journal's established policies. The journal will seek to ensure that allegations are neither dismissed without appropriate consideration nor treated as established misconduct without sufficient evidence.
Editorial Actions
Where research or publication misconduct is established or sufficiently substantiated, Justitia Nova may take one or more appropriate editorial actions. These may include rejection of a submitted manuscript, requests for clarification or additional documentation, or requirements for correction or revision.
For published articles, the journal may issue a Correction, Expression of Concern, or Retraction, depending on the nature and severity of the issue. Where appropriate and consistent with ethical and legal considerations, the journal may also notify the authors' affiliated institutions, employers, funding organizations, or other relevant authorities.
The journal reserves the right to take any additional editorial action necessary to protect the integrity and reliability of the scholarly record.
Post-Publication Integrity
Research integrity responsibilities continue after an article has been published. Allegations or concerns identified after publication will be assessed using the same principles of fairness, confidentiality, evidence, and due process applied during the editorial process.
Where necessary, the journal may publish corrections, errata, Expressions of Concern, retractions, or other editorial notices to ensure that readers are accurately informed about the status and reliability of published research.
Confidentiality and Good-Faith Reporting
The journal respects the confidentiality of individuals who report suspected research or publication misconduct in good faith. Information relating to an investigation will be shared only with individuals directly involved in the assessment or investigation, or where disclosure is required by applicable legal or ethical obligations.
The journal will make reasonable efforts to protect the confidentiality of good-faith reporters while also ensuring that authors and other parties involved in an allegation receive fair treatment throughout the investigation.
Continuous Improvement
The Editorial Board periodically reviews this policy to ensure that it remains consistent with developments in research integrity, publication ethics, Artificial Intelligence, and internationally recognized standards of scholarly publishing. Where necessary, the journal may update its procedures to strengthen research integrity and improve the transparency and effectiveness of editorial oversight.
