Complaints & Appeals Policy

Justitia Nova: Indonesian Journal of Modern Law is committed to maintaining fairness, transparency, accountability, and integrity throughout the editorial and publication process. The journal provides a formal mechanism for authors, reviewers, readers, and other stakeholders to submit complaints or appeal editorial decisions when they believe that a concern has not been appropriately addressed.

All complaints and appeals will be handled objectively, confidentially, and in accordance with the principles of the Committee on Publication Ethics (COPE).

Purpose

This policy aims to:

• Promote transparency and accountability in editorial decision-making.

• Ensure fair treatment of all parties involved in scholarly publishing.

• Provide a structured process for resolving complaints and appeals.

• Maintain confidence in the journal's editorial independence and publication ethics.

Complaints

Complaints may relate to, but are not limited to:

• Editorial procedures.

• Peer review process.

• Publication ethics.

• Research integrity.

• Conflicts of interest.

• Publication delays.

• Alleged misconduct by authors, reviewers, editors, or the publisher.

• Copyright or licensing concerns.

Complaints should be submitted in writing to the Editorial Office with sufficient supporting information to enable a fair assessment.

Appeals Against Editorial Decisions

Authors may appeal an editorial decision if they believe that:

• A significant procedural error occurred during the editorial process.

• The decision was based on factual misunderstandings.

• Relevant evidence or information was not adequately considered.

• A conflict of interest may have affected the editorial decision.

An appeal must provide a clear explanation supported by appropriate evidence.

Disagreement with reviewers' opinions alone is not sufficient grounds for an appeal.

Investigation Procedure

Upon receiving a complaint or appeal, the Editorial Office will:

• Acknowledge receipt of the submission.

• Conduct an initial assessment of the issues raised.

• Request additional information where necessary.

• Consult the Editor-in-Chief, relevant editors, reviewers, or independent experts as appropriate.

• Reach a decision based on available evidence and established editorial policies.

All investigations will be conducted fairly, objectively, and confidentially.

Editorial Decisions

Following the investigation, the journal may:

• Uphold the original editorial decision.

• Request additional peer review.

• Reconsider the manuscript.

• Correct administrative or procedural errors.

• Take appropriate editorial or ethical action where necessary.

The decision of the Editor-in-Chief following the completion of the appeal process shall normally be considered final.

Confidentiality

The journal will protect the confidentiality of all parties involved throughout the complaints and appeals process.

Information will be shared only with individuals directly involved in the investigation or where required by applicable legal or ethical obligations.

Good Faith

Complaints and appeals should be submitted in good faith and supported by factual information.

The journal reserves the right not to consider submissions that are abusive, defamatory, repetitive, frivolous, or unsupported by evidence.

Continuous Improvement

The Editorial Board periodically reviews complaints and appeals to improve editorial procedures, strengthen publication ethics, and enhance the quality and transparency of the journal's editorial practices.
